1. Acceptance
By using the IndieGauge app, you agree to these terms and the Privacy Policy. If you do not agree, do not use the app. They are offered by FlatOut.
2. Apple's standard terms
Your use of the app is also subject to Apple's standard license agreement (Apple Media Services Terms / Licensed Application End User License Agreement): Apple standard EULA. These website terms supplement it and are not a custom EULA.
3. Eligibility
You must be old enough to form a binding contract where you live, or use the app with a parent or guardian's permission and supervision.
4. License and permitted use
We grant you a limited, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, to configure and view readings from IndieGauge hardware you lawfully own or are authorized to use, for personal use.
5. Safety and driving
- Never interact with the app while driving. Pull over and park safely first.
- Install hardware and sensors safely and correctly, following instructions, and comply with local laws.
- Readings depend on installation, sensor condition, wiring, and calibration, and may be inaccurate, delayed, or unavailable.
- IndieGauge is not a safety system. Do not rely on it as your only warning of engine or vehicle problems, and do not use it in place of factory warning systems, professional inspection, or attentive driving.
6. Your responsibilities
You are responsible for how you install and use the hardware, your settings and warning thresholds, and your vehicle's condition.
7. Images you select
Images you choose stay on your device. You confirm you have the right to use any image you select and that it does not infringe anyone's rights or break the law.
8. Prohibited conduct
- Reverse-engineering, copying, or modifying the app except as law allows.
- Interfering with the app or hardware communication in unsafe or unlawful ways.
- Using the app to violate any law or anyone's rights.
9. Intellectual property
The app, hardware designs, and the IndieGauge name and branding belong to FlatOut or its licensors. You keep ownership of your own images.
10. Third-party services
The app is distributed through Apple's App Store and runs on iOS, which are governed by Apple's terms. We are not responsible for third-party services.
11. Suspension and termination
You may stop using the app at any time by deleting it. We may end or limit your license if you breach these terms. Sections that by nature should survive will survive.
12. Disclaimers
To the extent permitted by law, the app is provided “as is” and “as available” without warranties of any kind, including accuracy, reliability, or fitness for a particular purpose.
13. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental, or consequential damages, or for loss or damage to vehicles, engines, or property arising from use of or reliance on the app or hardware readings. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud.
14. Your statutory rights
These terms do not remove consumer rights that cannot be waived under the law where you live.
15. Governing law
These terms are governed by the laws of the Republic of the Philippines, subject to mandatory consumer protections where you live.
16. Changes
We may update these terms. We will post the new version here with a new “Last updated” date. Continued use means acceptance.
